States with Stand your Ground - States with Duty to Retreat - Clarity is needed



USA AMERICA |  To help ensure that information is shared for informed decision making, Milwaukee Professionals Association LLC will publish often information about Stand your Ground for spreading the news.  If you are thinking that this is only geared to African Americans, you got another thought coming.  Yes.  African Americans have been adversely affected with the precious lost of two of our 17 year old teen males, Trayvon Martin and Jordan Davis, just a few months apart in 2012.  It was also the year, 2012, Marissa Alexander received a 20-year sentence for shooting a warning shot to the wall during a battery assault of her estrange husband;. while associated with this law.  Being informed helps the citizenry separate myths and misconceptions from the truth.

Stand your Ground law in Florida lacks clarity.  In fact, it is the wrongful instructions given by the judge that was with the first trial for Marissa Alexander in 2012 that is the grounds for the NEW trial Marissa is now waiting on in March, 2014.  She has spent 2 of 20 years in prison.  She is now on "house arrest" as she waits for the NEW trial.  Then, there is the 10-20-life law of Florida that connected to the Stand your Ground law in Florida.  These are but some of the reason that Milwaukee Professionals Association LLC has launched the NOW IS THE TIME - REPEAL STAND your GROUND law.

States w/Stand your Ground law

The following information is taken from Findlaw.

Many states have enacted so-called stand your ground laws that remove the duty to retreat before using force in self-defense. Florida passed the first such law in 2005, generally allowing people to stand their ground instead of retreating if they reasonably believe doing so will "prevent death or great bodily harm."

Other states followed with laws specifically affirming one's right to defend themselves, even outside of their homes and with deadly force if necessary. The wording of the each state's laws will vary, but typically require you to have a right to be at the location. Here are the states that have passed stand your ground laws:

  • Montana

  • New Hampshire
  • Oklahoma

Note that some states have adopted stand your ground-like doctrines through judicial interpretation of their self-defense laws -- but they are not included in this list.

Some states have self-defense laws on the books that are similar to stand your ground laws, often with at least one key difference. These laws generally apply only to the home or other real property (such as an office) and are often referred to as "castle doctrine" or "defense of habitation" laws. These states include: Idaho, Illinois, Kansas, Michigan, Oregon, South Carolina, South Dakota, Washington, and West Virginia.

Duty to Retreat States
 On the other end of the legal spectrum, some states have laws imposing a duty to retreat. A duty to retreat generally means that you are not allowed to resort to deadly force in self-defense if it is possible to safely avoid the risk of harm or death (by running away, for example). If that is not an option, say if you were cornered or pinned down and facing serious harm or death, then you would be authorized to use deadly force in self defense. The following states impose some form of duty to retreat before using deadly self defense:

Injustice anywhere is a threat to justice everywhere.

NOW IS THE TIME for a Repeal of the Stand Your Ground laws in Florida and across the United States of America. Stop the Harm’s Way and lack of equal protection under the law.

Respect-4-Respect Petition is an effort to speak out about the Stand your Ground law specific Harm’s Way effect on African American. WE know it is African Americans, African American teenagers NOW; but, this law will claim other citizenry as time goes by with the same trigger-happy rule-of-thumb. Stand your Ground legally promotes lawlessness, discrimination, stalking, profiling, myths, criminalizing, privilege-to-kill and growing threat of by-design murder. 

The two recent trials in the state of Florida, in-the-court cases, for the death of two African American teenagers, Trayvon Martin, 17 years and Jordan Davis, 17 years proves that the law Stand your Ground is extremely bias and racial in its intent and implementation. It said the teens were automatically guilty even though they were not the perpetrators. It has sent a message of one-side law and privilege of the Caucasian race dictates rights (human-civil-legal) and one can shoot-and-kill without reprisal.

In January 2006, Ms. Bashen became the first African American female to hold a patent for a software invention. The patented software, LinkLine, is a web-based application for EEO claims intake and tracking, claims management, document management and numerous reports. Bashen will soon release the federal sector counterpart, EEOFedSoft, MD715Link and the web-based AAPSoft for building Affirmative Action Plans.

Janet Emerson Bashen was issued U.S. patent #6,985,922 on January 10 2006, for a "Method, Apparatus and System for Processing Compliance Actions over a Wide Area Network.

Biography
Janet Emerson Bashen, formerly Janet Emerson, attended Alabama A&M until she married and relocated to Houston, Texas, where she now resides.
Bashen’s educational background includes a degree in legal studies and government from The University of Houston, and postgraduate studies at Rice University’s Jesse H. Jones Graduate School of Administration. Bashen is also a graduate of Harvard University’s “Women and Power: Leadership in a New World.” Bashen will soon be pursuing her LLM from Northwestern California University School of Law.
Bashen maintains a very strong community commitment and is on the Board of Directors for the North Harris Montgomery County Community College District Foundation, and chairs the Corporate Advisory Board of the National Association of Negro Business and Professional Women’s Clubs, Inc., and is a Board member of the PrepProgram, a non-profit organization dedicated to preparing at-risk student athletes for college.

NIGERIA | By now, we have all heard reports that Tiwa Savage was arrested by Lagos policemen on Saturday night, but nobody knows what really happened; till now.

Tiwa Savage was arrested by the police for allegedly humiliating a policeman who apprehended her for violating some provisions of the Lagos State Road Traffic Law in front of Eko Hotels and Suites Victoria Island, on Saturday.
During the ensuing argument with the cop, Savage, who was said to have been infuriated by the development, allegedly removed the cap of the policeman.
She was then whisked away to the Victoria Island Police Division for humiliating and assaulting the policeman.

Jacksonville, Florida (CNN) -- Nineteen years ago, Ron Davis and Lucia McBath celebrated the birth of a son.

Sunday, they should have celebrated Jordan Davis' birthday with him. Instead, they faced the prospect of a new trial for the man accused of killing him.


A jury in Jacksonville on Saturday found Michael Dunn guilty of attempted second-degree murder for opening fire on three other teens in the same SUV as Jordan Davis -- but deadlocked on the murder charge against him in Davis' death.

MILWAUKEE, Wisconsin | City Center - As part of its effort to reduce discrimination, profiling, myths, criminalizing, murder and by-design Enduring Concentrated Poverty in the world, especially Milwaukee; the RESPECT-4-RESPECT campaign is launched.

African American babies, moms, dads, youth, young adults, relatives, seniors, elders make-up their immediate family.  The foster parents and guardians have stepped in to fill the voids caused by the social diseases that have separated family members.

It is important to note that even though our families have a history of being "separated", still we rise recognizing the importance of mom, grandmother, dad, sister, brother, grandfather, aunt, uncle and extended family [slaves sold on Auction blocks, men and women forced to separate from family during key childhood growth to work for a Caucasian owner; our men sent away, men, children and women made to work in the fields for sharecropping (misnamed) and as domestics (whenever needed) to take care of Caucasian families while their children go lacking; to work without wages or proper wages, benefits and social security not paid; separated during Jim Crow with bombings, beatings and castration of our men and killing of African American men - placed with weights on them and put in rivers and/or hung-from-a-tree; African American women were separated from their husbands and sought for the sexual pleasure of the Caucasian owners;  and young girls' virginity taken by Caucasian; separated when family members were sold separately as mother, father and child - depending on the desires of the Caucasian owner].

Today, it is the separation by double- and triple standards for selfish gains in the marketplace or targeted crimes for "misdemeanor" and "felony" crimes that disproportionate snag African American and other People of Color - Truth and Sentencing (heavy overuse and misuse).  The separation by wholesale criminalizing and decade stocking of mega prisons (industrial prison complex) in small Caucasian towns and cites to boost their economy.  Our men and women separated by many, many miles and family face difficulty to visit.

Then there are permanent separations caused by life sentencing (3 strikes you out drug crimes) and murders by homicides in the neighborhood vy neighbors and by police. Separation of young males and females, men and women head of household (parents) have caused family "breaks", but no matter what, we stay connected.  Then, there are the false cases found false after decades of imprisonment.  I wonder how many of us are sitting in "prison" falsely convicted by those who failed to give "due process" because of bigotry and racism?  How many have been put to death that were innocent?

Recently, we see a new phenomenon, "Stand your ground" law that has taken the life of two young African American males under 20.  They were murdered. We have gone too far.  Whether it is homicides at the census tract and neighborhood level by members of the same race or police.  Or, Caucasian stalking - vigilante - privileged thinking that is more and more a threat. This is not right.  We must stop it cold.  It has become a "sick addiction" by some.

RESPECT-4-RESPECT
Milwaukee Professionals Association LLC is gearing up for ongoing response to the "open season", predatory and growing threats of the man-made diseases that prompt hate, psychopathic and sociopathic behaviors, distrust, and privilege-thinking.

The word-of-mouth campaign will allow LIKE-MINDS to join in solidarity to prevent and turn-off the lawlessness, violence, shootings, brutality, murders and economic sabotage for response to the diseases of racism, bigotry, discrimination, intolerance, exploitation, bullying and by-design Enduring Concentrated Poverty.

Milwaukee Professionals Association LLC knows that we can do better, if we choose to.  This is your "Call to choose to".  

Respect-4-Respect is another effort of AHOD/All Hands on Deck, WE CAN to re-define, re-brand and UN-trap hidden talent and vetted businesses at the census tract and neighborhood level, especially African American and other People of Color.  These are the diverse populations that traditionally are burden with disparity and remain so far from deserved economics -  even though People of Color work and pursue the rights guaranteed under the law.  Even though they work two or more jobs to feed their families, pay their bills, plan to send their offsprings to college and the pursuit of happiness - Even though they are upright and law abiding - They remain with an infrastructure sub-level to what they put in the coffers.  

Respect-4-Respect says, Enough already!

Respect-4-Respect says, Earth is the only planet known at this time a human can habitat for generations, it is wise that we get along.

Respect-4-Respect says, put yourself in the other person's place and see how you fair.

RESPECT-4-RESPECT says no one is Exempt.

Respect-4-Respect says, document criminalizing incidents with "Storytelling" and be sure to call names and give timeframes.
  
Respect-4-Respect says compete for a more aware and engaging neighborhood and world of ownership, citizenship, stewardship and accountability by ALL.

Respect-4-Respect says "put-in-check" inappropriate acts and remove those who fail to respect African American and other People of Color with "quickness" - this includes incarceration of elected-appointed-hired representatives, MEDIA pressure to print the ugly truth, use the tool of "recall" more often as well as joint and/or class-suits with "7-figure plus amounts attached".

Respect-4-Respect says tell the true stories so myths are corrected, rich and vibrant cultures are known and state-of-the-art wrongdoings are front and center for those who do not care, those in denial and those who do not know.

Respect-4-Respect says if you are a Caucasian Millennial that feel you have NO responsibility to what your forefathers did to enslave or your parent generation continued wrong to African American, you will need not only to "re-think your thesis" but you will need to benchmark your future with a leadership to correct the wrongs of "false and misguided" privilege behavior in the public square - this starts with not turning a blind-eye to wrongful acts that are unjust, how you treat African American and other People of Color and the vigorous change of LAWS that perpetuate racism. 

Respect-4-Respect says the African American and People of Color have a leadership, citizenship and stewardship role and responsibility that calls for honoring your history of leadership in America.  African American Born Frees and Millennials must be academic smart and technology savvy.  They must promote safety prevention and intervention, health wellness in your neighborhood, role-modeling, respect-for-self as well as others, dress code - acceptable public dress code, correct "in-public" language and decorum, civility, honoring your duty as a man, woman, child, bringing NO shame to your family, keeping up neighborhood beauty, passing-on and using your African and American cultures, teaching the young with "by-positive example" and using religiously voting practices to send the message of accountability.

Law and order exist for the purpose of establishing justice and when they fail in this purpose they become the dangerously structured dams that block the flow of social progress.
